Agreement to Terms

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Borderless Commerce ("Company", "we", "us", or "our"), concerning your access to and use of the www.borderlesscommerce.net website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site"). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Site.

Products

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

Purchases and Payments

We accept the following forms of payment: Visa, Mastercard, American Express, Discover, and Bank Transfer.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. All payments shall be in U.S. dollars.

Authorization for Recurring Charges: By subscribing to any recurring services, you authorize Borderless Commerce to charge your provided payment method in accordance with the billing schedule.

Return/Refunds Policy

You can make a refund claim within 5 days of your purchase, and we can ask the supplier to issue a refund. Any items already shipped outside of the origin country do not qualify for a refund. Refund requests must be made while the products are still at origin within the 5-day period. Subscription refunds are available within 15 days of billing (if applicable).

Prohibited Goods

We strictly prohibit the handling, storage, or shipment of: illegal drugs or controlled substances; firearms, ammunition, and weapons; explosives or hazardous materials; counterfeit or trademark-infringing products; adult content; and any goods restricted by international sanctions or embargoes.

Sanctions & Geographical Restrictions: We do not accept orders from, nor do we ship to, countries subject to comprehensive international sanctions or embargoes (such as Iran, North Korea, Crimea, Syria, Cuba).

Customer Verification (KYC) and Anti-Money Laundering (AML) Compliance

Borderless Commerce LLC reserves the right to verify the identity of any customer, regardless of transaction size, in order to comply with international trade regulations and prevent fraud. We screen all orders against international sanctions and embargo lists (OFAC, EU, UN, etc.).

Disclaimer

THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF.

Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES. OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING OR $100.00 USD.

Company Information

Borderless Commerce LLC is a limited liability company legally registered in the State of Florida, USA. We operate as a sourcing and logistics service provider, assisting customers in purchasing and shipping consumer goods from international marketplaces.

Dispute Resolution

The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration. The governing law of the contract shall be substantive law of the United States.
